3. Client/ User Responsibilities 3.1. By purchasing any product on our website, you are considered a client/user of Faster WP Websites. 3.2. The terms “client” and “user” are interchangeable throughout this document, excepting the CEO. 3.3. Faster WP Websites does not engage in reselling or attempting to profit from the sale of plugins on this website. 3.4. Access to services, including plugin installation and continuing use, is granted through agency subscriptions, providing rights to the services of several plugins on the website. 3.5. You agree to allow Faster WP Websites access to all login and account information regarding hosting and domain services in connection with a website being examined or accessed in any way by Faster WP Websites, its owners, and assignees. 3.6. You agree not to store or upload any files that are illegal or violate any laws or regulations unless supported by humanitarian necessity and guided by codes of conduct regulating the protection of marginalized and persecuted groups under UN law.
4. Intellectual Property 4.1. Faster WP Websites retains ownership of all intellectual property rights associated with the WordPress website, unless otherwise agreed upon in writing. 4.2. You agree not to reproduce, distribute, or modify any content from our website without prior written consent. 4.3. Resale of accounts, information, insights, analytics, or other intellectual property claimed by Faster WP Websites is strictly prohibited within a standard of reasonability.
5. Payment and Billing 5.1. Payment terms and conditions will be specified in the agreement or contract between Faster WP Websites and the client/user. 5.2. It is your responsibility to pay all fees and charges by the specified due dates. 5.3. A service fee of 3% will be applied to credit card transactions. You agree to pay this service fee for credit card payments. 5.4. You acknowledge and accept responsibility for any relevant tax burden associated with the services provided by Faster WP Websites. 5.5. If a subscription lapses due to failed payment for any reason, Faster WP Websites may suspend or terminate services.
6. Use of Agency and Professional Subscriptions 6.1. Faster WP Websites, if accepting you as a client/user, may utilize Agency and professional subscriptions on your behalf for the purpose of providing services. 6.2. You acknowledge that Faster WP Websites is not reselling or attempting to profit from the sale of plugins on this website. 6.3. Access to services and plugins is granted through agency subscriptions, providing you with the right to use and benefit from the services of those plugins.
7. Work Schedule and Holidays 7.1. Work schedules, including project timelines and availability, are at the sole discretion of Faster WP Websites. 7.2. Faster WP Websites may not operate or provide services on national holidays or other designated holidays. 7.3. The specific holidays and non-working days will be communicated to clients/users in advance.
8. Limitation of Liability 8.1. You will not hold Faster WP Websites, its owners, assignees, and/or aliases liable for any loss of server access, email access, hosting, or data. 8.2. You explicitly recognize that all DNS and hosting services are handled by you, on your own billing, and never at the expense of Faster WP Websites or employees connected with it. 8.3. Hosting is your responsibility. Faster WP Websites can provide assistance in recommending a web host and plan, but you acknowledge that “our” web servers are simply recommendations. 8.4. If you fail to pay the hosting or domain bill, Faster WP Websites has no responsibility or liability in that regard.
9. Additional Analytics Data and Insights 9.1. Faster WP Websites may, at its discretion, provide additional analytics data and insights to clients/users. 9.2. The availability and extent of such analytics data and insights will be determined by Faster WP Websites. 9.3. Clients/users acknowledge that the provision of analytics data and insights is not guaranteed and is subject to the sole discretion of Faster WP Websites.
10. Trust and Commitment 10.1. Both parties recognize that at the end of the day, this is about trust. Faster WP Websites is a company (often operated by a single individual) dedicated to providing clients with access to a range of tools that have been experimented with and can broadly be endorsed. 10.2. Faster WP Websites expects clients to be forthright and honest in their dealings. 10.3. In return, Faster WP Websites is committed to continuously improving and providing better services to clients.

11. Storage Services 11.1. Faster WP Websites provides storage services to assist in the transit of assets during the website creation process. 11.2. However, Faster WP Websites is not a long-term storage solution and does not guarantee the protection or privacy of these assets. 11.3. Clients understand and acknowledge that it is their sole responsibility to ensure the backup, security, and long-term storage of their assets, including any sensitive or confidential information.

12. Data Privacy and Compliance 12.1. Faster WP Websites strives to be GDPR compliant and respects your privacy rights. We are committed to protecting your personal data and complying with applicable privacy laws and regulations. 12.2. If you have any concerns or questions regarding data privacy or compliance, please notify us promptly. We will make every effort to address your concerns and take appropriate actions to exceed legal standards. 12.3. Failure to disclose any concerns related to data privacy and compliance that may affect our services or your rights may result in the termination of services provided by Faster WP Websites.

13. Dispute Resolution 13.1. In the event of any disputes arising out of or in connection with these terms and conditions, the parties agree to seek resolution through negotiation and, if necessary, mediation. 13.2. If mediation does not result in a resolution, both parties agree to submit the dispute to a neutral arbiter or alternative dispute resolution mechanism agreed upon by both parties. 13.3. The purpose of this provision is to encourage open communication and amicable resolution of disputes to avoid protracted legal proceedings.

14. Modification of Terms 14.1. Faster WP Websites reserves the right to modify these terms and conditions at any time. 14.2. Notice of any modifications will be provided to clients/users through a prominent notice on our website or via email. 14.3. By continuing to use our services after such modifications, you acknowledge and agree to be bound by the revised terms and conditions. 14.4. It is your responsibility to review the updated terms and conditions periodically and stay informed of any changes.

15. Severability 15.1. If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement 16.1. This Agreement constitutes the entire agreement between you and Faster WP Websites and supersedes all prior or contemporaneous agreements, understandings, or representations, whether oral or written, relating to the subject matter of this Agreement.

17. Governing Law and Jurisdiction 17.1. This Agreement shall be governed by and construed in accordance with the laws of the United States of America and New York State, without regard to its conflict of law principles. 17.2. Any disputes arising out of or in connection with this Agreement shall be mediated and subject to the exclusive jurisdiction of the courts of New York State.

18. Non-Assignment 18.1. You may not assign or transfer any rights or obligations under this Agreement without the prior written consent of Faster WP Websites. 18.2. Faster WP Websites reserves the right to assign or transfer any rights or obligations under this Agreement to a third party without your consent.

19. Waiver 19.1. The failure of Faster WP Websites to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision. 19.2. The waiver of any breach of this Agreement shall not constitute a waiver of any subsequent breach or a waiver of the provision itself.

20. Relationship of Parties 20.1. The relationship between you and Faster WP Websites is that of an independent contractor, and nothing in this Agreement shall be construed as creating a partnership, joint venture, employment, or agency relationship between the parties.

21. Force Majeure 21.1. Faster WP Websites shall not be liable for any failure or delay in the performance of its obligations under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes, and governmental actions.

22. Survival 22.1. Any provisions of this Agreement that by their nature should survive termination or expiration, including but not limited to intellectual property rights, limitation of liability, and dispute resolution provisions, shall survive and remain in effect after the termination or expiration of this Agreement.
